1. The service

MarineLens ("the App") is an iOS productivity application for marine surveyors, boatyards, marinas, and detailers. It captures LiDAR-measured hull observations, ABYC checklist results, voice notes, and exports a survey report PDF. All processing happens on your iPhone. NEXASPHERE INC. ("we", "us") publishes the App via the Apple App Store. By installing or using the App you ("you") agree to these Terms.

2. Subscriptions and billing

MarineLens offers four auto-renewing subscription products in v1: Surveyor Solo monthly at $99 per month with a 7-day free trial, Surveyor Solo annual at $999 per year with a 7-day free trial, Shop Pro monthly at $149 per month, and Shop Pro annual at $1,499 per year. Pricing for additional tiers and one-time purchases may be added in future releases.

All billing is handled by Apple via StoreKit. You manage your subscription in iOS Settings under your name, Subscriptions, MarineLens. Cancel anytime there. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under Apple's refund policy at reportaproblem.apple.com. We do not process payments and cannot issue refunds directly.

Prices may change. If we change a subscription price, Apple will notify you and request your consent before the change takes effect.

3. License

Subject to these Terms, we grant you a personal, non-transferable, revocable, non-exclusive license to install and use the App on iOS devices you own or control, for your own professional use.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App in violation of applicable law, including marine survey, recording, and image-rights laws in your jurisdiction
• Use the App to harass, defame, or violate the privacy of any third party
• Share, sublicense, or resell the App or your subscription
• Use the App in any way that could harm Apple, NEXASPHERE INC., or other users

5. Survey reports are professional opinion

Survey reports produced by MarineLens are tools to support your own professional judgment as a marine surveyor or operator. They are not a substitute for your training, your credentials, or your professional standards body (for example IIMS, SAMS, or NAMS). You remain solely responsible for the accuracy, completeness, and legal defensibility of every report you sign and deliver. LiDAR measurements carry a confidence score that reflects raycast stability and lighting; you are responsible for re-measuring when confidence is low.

6. AI features

MarineLens v1 includes a deterministic on-device draft generator that composes a paragraph from your recorded LiDAR measurements, voice notes, and the selected ABYC chapter. This is a writing aid, not legal or surveying advice, and is not a generative language model. If we add generative AI drafting in a future version, it will be subject to clear disclosure of the model used and any data handling implied.

7. Your content

All surveys, work orders, vessel records, voice notes, LiDAR captures, photos, and PDFs produced by the App are your content. They are stored exclusively on your device. You retain all rights to your content. We do not access, view, or claim any rights to your content. See our Privacy Policy at /products/iphone/marinelens/privacy.

8. Our intellectual property

The App itself, including its code, design, brand, templates, and documentation, is owned by NEXASPHERE INC. and protected by copyright, trademark, and other intellectual-property laws. These Terms do not grant you any rights to our trademarks or brand. ABYC chapter codes referenced in the App are property of the American Boat and Yacht Council; MarineLens summarises chapter scope as a convenience, not as an authoritative source. Always reference the current ABYC standard text for compliance work.

9. No warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXASPHERE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING ANY CLAIM ARISING FROM A SURVEY REPORT PRODUCED WITH THE APP. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE APP AND THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) $100 USD.

11. Indemnification

You agree to indemnify and hold harmless NEXASPHERE INC. from any claims, damages, or expenses arising out of your violation of these Terms, your misuse of the App, your delivery of a survey report produced with the App, or your violation of any law or third-party right.

12. Termination

You may stop using the App and cancel your subscription at any time via iOS Settings. We may suspend or terminate your access to the App if you violate these Terms. Provisions that by their nature survive termination (including sections 8, 9, 10, 11, 13, and 14) will survive.

13. Apple-specific terms

You acknowledge that these Terms are between you and NEXASPHERE INC., not Apple. Apple is not responsible for the App or its content. To the extent these Terms conflict with Apple standard end-user license agreement for App Store apps, the relevant provisions of Apple EULA apply. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the state and federal courts located in Delaware.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the Effective Date above and may also notify you in the App. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.
