1. The service

InspectAI ("the App") is an iOS application published by NEXASPHERE INC. ("we", "us") via the Apple App Store. InspectAI generates LiDAR-based property inspection reports for small property managers. Scan a unit, log conditions, and produce a branded PDF for the owner or tenant. Everything stays on the iPhone. By installing or using the App, you ("you") agree to these Terms.

2. Subscriptions and billing

InspectAI offers a free tier and an auto-renewing subscription that unlocks unlimited inspections and exports. Pricing is shown in the in-app paywall. All billing is handled by Apple via StoreKit. You manage your subscription in iOS Settings under your name, Subscriptions, InspectAI. Cancel anytime there. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple under Apple's refund policy at reportaproblem.apple.com. We do not process payments and cannot issue refunds directly.

Prices may change. If we change the subscription price, Apple will notify you and request your consent before the change takes effect.

3. License

Subject to these Terms and the Apple Standard EULA at apple.com/legal/internet-services/itunes/dev/stdeula, we grant you a personal, non-transferable, revocable, non-exclusive license to install and use the App on iOS devices you own or control, for your own personal or professional use.

4. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use the App in violation of any applicable law
  • Use the App to harass, defame, or violate the privacy of any third party
  • Share, sublicense, or resell the App or your subscription
  • Use the App in any way that could harm Apple, NEXASPHERE INC., or other users

5. Professional-liability disclaimer

InspectAI is a documentation and report-writing aid. It does not perform inspections, does not certify findings, and is not a substitute for the professional judgment of a licensed inspector or relevant subject-matter expert. You are solely responsible for the accuracy of your inspection findings, the completeness of each report, compliance with applicable professional standards and local regulations, and any errors-and-omissions coverage that applies to your work. Review every section of every report before delivering it to a client.

6. Your content

All content you create or import into the App (notes, photos, recordings, transcripts, generated reports, exported PDFs) ("Your Content") is yours. Your Content is stored exclusively on your device. You retain all rights to Your Content. We do not access, view, or claim any rights to Your Content. See our Privacy Policy at /products/iphone/inspectai/privacy for details.

7. Our intellectual property

The App itself, including its code, design, brand, templates, and documentation, is owned by NEXASPHERE INC. and protected by copyright, trademark, and other intellectual-property laws. These Terms do not grant you any rights to our trademarks or brand.

8. No warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXASPHERE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE APP AND THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) $100 USD.

10. Indemnification

You agree to indemnify and hold harmless NEXASPHERE INC. from any claims, damages, or expenses arising out of your violation of these Terms, your misuse of the App, or your violation of any law or third-party right.

11. Termination

You may stop using the App and cancel your subscription at any time via iOS Settings. We may suspend or terminate your access to the App if you violate these Terms. Provisions that by their nature survive termination will survive.

12. Apple-specific terms

You acknowledge that these Terms are between you and NEXASPHERE INC., not Apple. Apple is not responsible for the App or its content. To the extent these Terms conflict with Apple's standard end-user license agreement for App Store apps, the relevant provisions of Apple's EULA apply. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the state and federal courts located in Delaware.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the Effective Date above and may also notify you in the App. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.
