1. The service

Hypertension Diary ("the App") is an iOS application that helps adults monitoring blood pressure at home log their readings, track medication changes, and generate a doctor-facing PDF for follow-up visits. The App is a logbook. It does not measure blood pressure, does not estimate blood pressure, and is not a medical device. NEXASPHERE INC. ("we", "us") publishes the App via the Apple App Store. By installing or using the App you ("you") agree to these Terms.

2. Subscriptions, lifetime purchase, and billing

Hypertension Diary offers an annual auto-renewing subscription at $49.99 per year with a 7-day free trial, and a one-time lifetime purchase at $129. An abandon-flow offer of $24.99 for the first year may be presented one time per install at our discretion. After the 7-day free trial ends, the annual subscription will be charged to your Apple ID and will renew automatically each year unless you cancel at least 24 hours before the renewal date. You can manage or cancel subscriptions in iPhone Settings under your name, Subscriptions, Hypertension Diary. All billing is handled by Apple. We do not see and do not store your payment information.

3. Free vs paid features

The free state lets you log readings and view the last 7 days of history. The paid tier unlocks unlimited history, AM and PM trend chart ranges beyond 7 days, the medication-change overlay on the chart, and the doctor-PDF export. Free-state features are not disabled if your subscription lapses; only the paid tier entitlements become locked again until you renew or buy lifetime.

4. Medical disclaimer

Hypertension Diary is for educational and personal-organization purposes only. It is not a substitute for medical advice, diagnosis, or treatment from a licensed clinician. The readings, averages, stage labels, and PDF reports produced by the App are derived from the numbers you enter and are not validated against an FDA-cleared device. Always consult your clinician about your blood pressure, medications, and treatment plan. If you believe you are experiencing a hypertensive crisis or any medical emergency, call your local emergency services immediately.

5. Your responsibility

You agree that you will:

• Use the App only to record your own readings or readings of a person whose blood-pressure log you are explicitly authorized to keep
• Not rely on the App for diagnostic or treatment decisions without consulting a licensed clinician
• Verify any readings against your blood-pressure cuff or office machine
• Keep the iPhone the App runs on physically secure since the readings are stored on device

6. Intellectual property

The App, the Hypertension Diary name, the user-interface design, the PDF layout, and all related code are owned by NEXASPHERE INC. You are granted a personal, non-exclusive, non-transferable license to use the App for personal use, subject to these Terms and the Apple Standard EULA at apple.com/legal/internet-services/itunes/dev/stdeula.

7. No warranty

The App is provided "as is" without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or that the readings, averages, or PDF reports will be accurate or fit for any particular medical or clinical purpose. You use the App at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, NEXASPHERE INC. is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits or revenues, arising from your use of the App. Our total liability for any claim arising from these Terms or your use of the App is limited to the amount you paid us for the App in the 12 months preceding the claim.

9. Changes to these Terms

We may update these Terms when the App changes materially. We will update the Effective Date above. Continued use of the App after a material change constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
